1. Overview of ShopSTR

Shopstr provides a platform connecting hosts offering vacation rentals or experiences with guests seeking to book them. Our platform allows hosts to create and share direct booking links. ShopSTR does not process payments, facilitate bookings, or mediate disputes. All transactions, communication, and arrangements are handled directly between hosts and guests.

2. Acceptance of Terms

By using the ShopSTR platform, you confirm that you are at least 18 years old and capable of entering into legally binding agreements. If you do not agree to these Terms, you must discontinue use of the platform.

3. Responsibilities of Hosts

  • Accuracy of Information: Hosts are solely responsible for providing accurate, complete, and up-to-date information about their properties or experiences.
  • Direct Communication: Hosts are responsible for communicating with guests to finalize booking details, payment terms, and other relevant arrangements.
  • Refund Policies: Hosts must clearly communicate refund policies for their listings, as Shopstr does not manage refunds.
  • Compliance: Hosts must adhere to all applicable local laws, regulations, and licensing requirements.

4. Responsibilities of Guests

  • Due Diligence: Guests are responsible for independently verifying the accuracy of information provided by hosts, including payment terms and refund policies.
  • Direct Payment: Guests must arrange payment directly with hosts and ensure compliance with agreed-upon terms.
  • Identity Verification: Some listings may require identity verification before booking. Guests must comply with this requirement where applicable.

5. ShopSTR's Limited Role

  • Listing Criteria: ShopSTR provides minimal criteria for host listings and does not actively verify their accuracy or legitimacy. Guests are encouraged to perform due diligence before making any bookings.
  • Messaging and Reviews: The platform offers messaging features to facilitate communication between ShopSTR, hosts, and guests. It also includes a review system to help users make informed decisions. ShopSTR reserves the right to moderate these features but is not liable for their content or usage.

6. Limitation of Liability

ShopSTR acts solely as a listing and link-sharing platform and is not responsible for:

  • The accuracy of listings or the conduct of hosts or guests.
  • Any disputes, cancellations, damages, or other issues arising from bookings.
  • Financial transactions, including refunds or chargebacks.
    By using ShopSTR, you acknowledge and agree that ShopSTR has no liability for any direct, indirect, incidental, or consequential damages related to your use of the platform.

7. Indemnification

You agree to indemnify and hold harmless ShopSTR, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses arising out of your use of the platform, including disputes between hosts and guests, or any violation of these Terms.

8. Prohibited Activities

You agree not to:

  • Misuse the platform or engage in any activity that violates applicable laws or infringes on the rights of others.
  • Use the platform for purposes other than its intended use, such as fraud or deceptive practices.

9. Intellectual Property

All content, trademarks, and designs associated with ShopSTR are the property of ShopSTR or its licensors. You may not use or reproduce any intellectual property without prior written consent.

10. Termination

ShopSTR reserves the right to suspend or terminate your access to the platform at its sole discretion, including for violations of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved exclusively in the courts of New York.

12. Modifications

ShopSTR may update these Terms at any time without prior notice. Changes will be effective immediately upon posting to the platform. Continued use of the platform constitutes acceptance of the revised Terms.
